    Program Title: "Triple Threat, Wellness Program Compliance under HIPPA, GINA and ADA"

    More and more employers have started to offer employee prizes or cash rewards for exercising, losing weight or even making employees eligible for lower health insurance premiums if they complete a health risk assessment.  While employee wellness programs are a useful tool to encourage employees to engage in their own health, they can also pose compliance risks for employers.  Increasing regulation of wellness programs means employers must now juggle there sets of new (and sometimes inconsistent) regulations under HIPAA, the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA.  In the past 18 months, courts have also taken a look at employer wellness programs after a flurry of lawsuits by the Equal Employment Opportunity Commission (EEOC).

    This presentation will highlight new developments in wellness program compliance with a focus on new regulations under the ADA and GINA that impact all types of employer wellness programs, even those that may not be linked to participation in a group health plan.  However, it doesn’t end there – in addition to staying in compliance with this volatile area of the law, employers must continually evaluate their wellness programs for success. The presenter will bring to light common wellness program mistakes and identify recent trends to help employers maximize their investment by crafting targeted wellness programs designed to engage employees and promote long term cost savings.

    Attendees will leave with an overview of considerations and action items for employers implementing, as well as those who are seeking to improve the effectiveness of their wellness program.

    Dax graduated from the University of North Carolina at Chapel Hill with a Bachelor of Arts degree and resides in Durham with his wife and two children.

    BENJAMIN GARNER, JD

    Benjamin Garner, JD is a compliance advisor for Hill, Chesson & Woody, a division of Gallagher Benefit Services, Inc.

    In this position, Benjamin educates staff and clients on the multitude of laws and regulations that affect health and welfare benefit plans to ensure employers are compliant and avoid or mitigate risk. He also conducts a compliance review for new clients and creates a compliance plan of action that outlines gaps and identifies suggestions to improve compliance.

    Prior to joining HCW in February 2017, Benjamin spent almost four years at the N.C. Department of Commerce as the Chief of Unemployment Insurance Adjudication in the Division of Employment Security. Prior to that, he worked in corporate law and compliance.

    Benjamin graduated from the University of North Carolina at Chapel Hill in 2004 with Bachelor of Arts in history and English. He received his J.D. from Regent University School of Law in 2010 and is licensed to practice law in North Carolina.

    He is ingrained in the community – he leads a small group and teaches at his church and helps lead an organization for boys in the fourth through sixth grades that focuses on skills, leadership, and character development. He resides in Youngsville, N.C. with his wife and children.
